Artikel 16, stk. 2, i TEUF giver Europa-Parlamentet og Rådet beføjelse til at fastsætte regler om beskyttelse af fysiske personer i forbindelse med behandling af personoplysninger og regler om fri udveksling af sådanne oplysninger.
